Summarize the issue presented in the article.
Explain whether or not you think the issue pushes against the governmental separation of powers that is in place.
In my opinion, this issue does push against governmental separation of powers; however, whether or not it should is a difficult question to answer. On one hand, having Congress exert too much influence on the judiciary can lead to a weakening of its independence – something which is essential for checks-and-balances within the federal system. On the other hand, allowing judges free reign over their decision making could result in rulings which go against existing laws or even create new ones without proper public debate or scrutiny. Therefore it’s easy to see why some people would argue that having some form of oversight – albeit limited – could help maintain balance in order to ensure fair decision making from all branches of government.
Ultimately though it will come down to how such oversight can be implemented without compromising independence or undermining any branch’s autonomy as enshrined in our Constitution. It seems likely that both sides may need to compromise if meaningful progress towards achieving this goal is ever going to be made
