Scenario: Steely City Council (SCC) have contacted your PQS practice for advice on what temporary arrangement they could use, prior to a substantive contract, to engage a construction contractor to reconstruct a main bridge on an arterial road which collapsed following a week of torrential rain in the region.
Due to the importance of the arterial road to the main city and the wider region, there is an urgent need for an immediate start to the project to avoid any potential impact to the local economy. SCC have heard that they could use a ‘Letter of intent’ as a temporary measure to mobilise the reconstruction of the bridge quickly but are not sure about its implications.
Beside the letter of intent, they also require advice on the most appropriate standard form of construction contract to create a legally binding relationship between themselves and the contractor to carry out the works when they are able to put one together.
Aware of the increasing rate of contractor insolvency in the region. SCC are also looking for advice on how they could safeguard their interests in case a contractor becomes insolvent while in the process of reconstructing the bridge.
