Can the crack cocaine be used against the tenant? 3. Mr. West is crossing from Canada into the United States. His car is in good working order, it doesn’t smell like drugs, and there are no warrants out for Mr. West. Still, Customs Agent North asks Mr. West to pull over so they can go through his car. In the trunk, they find bootleg DVDs labeled for sale. They want to use the counterfeit merchandise to charge Mr. West. Can they use it? 4. Police are called to a home where there is a suspected drug use. One roommate answers the door. The other roommate is in the kitchen. Through the open door, the police are able to see a large baggie of marijuana on the coffee table. They want to use it to charge the roommates. Can they? 5. Police are called to Mr. John’s apartment on a domestic disturbance call. Ms. Jane, his girlfriend, opens the door. The police ask Ms. Jane if she lives there. She lies and says yes. They then ask if she minds if they look around. She says, “No, go ahead!” knowing full well the police will find Mr. John’s illegal handgun sitting out. Mr. John is arrested. He moves to have the evidence suppressed since it was his apartment and he didn’t consent. Will Mr. John be successful in keeping the evidence out in court? 6. Mr. F is arrested on the charge of murdering a young girl. He invokes his right to an attorney. When they are transporting him to the country jail, the officers try to guilt him. They say things like, “It’s the holidays; it sure would be nice for the family to know what happened to their daughter,” and “She was so young and innocent; she at least deserves a good Christian burial.” Mr. F breaks down and tells them to pull off the road. He takes them into the woods and shows them where the body is. It is notably close to where volunteers are busy combing the woods looking for her. Will this evidence be allowed in court?
